Federal E.P.A., California C.A.R.B and Individual State Laws

Federal E.P.A. and individual state laws make it illegal to remove properly functioning OEM catalytic converters from vehicles operated on public streets and highways. As such, installations of Cone Performance products are not legal for sale or installation on vehicles operated on public streets and highways.

NOT LEGAL FOR SALE OR USE IN CALIFORNIA ON ANY POLLUTION CONTROLLED MOTOR VEHICLE. Use of select racing products on highway motorcycles may not be emissions-compliant. Aftermarket Critical Emission Control Parts are regulated by the California Air Resources Board (CARB). Since these parts may replace or otherwise interfere with the operation of emission controls (such as a catalytic converter or oxygen sensor), their use could be considered tampering under California's anti-tampering law, Vehicle Code Section 27156.

The installation, sale, offer for sale, or manufacture of this product may also be ILLEGAL NATIONWIDE UNDER THE FEDERAL CLEAN AIR ACT (42 U.S.C. § 7522(A)(3)). Users must comply with all federal, state, and EPA regulations. It is the purchaser’s responsibility to determine suitability of parts for their motorcycle application and ensure compliance with ARB emissions regulations. This required disclaimer satisfies the provisions of California Code of Regulations, title 13, Section 2222(b)(2).

Emission-related parts for OEM non-emission control system equipped motorcycles as well as slip-on mufflers that mount downstream of and which do not alter the performance of OEM emission related devices are considered legal replacement parts by the California Air Resources Board (CARB). CARB does not, however, permit the use of aftermarket parts that remove or alter OEM emission control devices unless certified by CARB, other than for closed circuit race use only.
